Medical consent

1. Consent to telehealth

Telehealth means delivering healthcare services through electronic communications, information technology, or other means between a healthcare provider and a patient who are not physically in the same place. When you use M&S Labs services, you consent to receiving care through telehealth.

Consultations are carried out in the way the laws of your state of residence require. If your state requires a synchronous, real-time audio or video encounter in order to establish a patient-provider relationship or to prescribe, your consultation will take place by live video or by telephone, as applicable. If your state allows it, your provider may evaluate you asynchronously through your health intake and secure messaging.

Benefits you can expect:

• Better access to healthcare, because consultations can happen wherever you are
• More efficient evaluation, management, and monitoring of your health
• Access to expertise that may not be available near you
• Shorter wait times and less need to travel

Risks that may arise:

• Limitations caused by technical problems, such as poor image quality or interrupted connections
• Equipment that fails or technology that is not compatible
• Possible security risks to electronic communications, even with encryption in place
• Diagnostic accuracy may be limited because a provider cannot perform a physical examination
• Evaluation and treatment may be delayed by shortcomings in technology

2. Your consent to using telehealth

When you use M&S Labs services, you acknowledge and agree that:

• You understand what telehealth is and what its limitations are
• You authorize your healthcare provider to provide weight management care through telehealth
• You understand that telehealth may involve sending your health information electronically
• You may withdraw your consent at any time, and doing so will not affect your right to future care
• You understand that your provider may decide telehealth is not appropriate for your condition, and if so you will be referred to in-person care

3. HIPAA consent

Under the Health Insurance Portability and Accountability Act (HIPAA), you acknowledge that:

• Your health information will be kept confidential and will be used only in the ways our Notice of Privacy Practices describes
• Electronic health records are stored securely, with appropriate access controls
• We may contact you about appointment reminders, updates to your treatment, or care coordination
• Any third-party vendor that accesses your data is bound by a business associate agreement
• You have the right to ask for access to your health information, for corrections to it, or for restrictions on how it is used

4. Financial consent

When you enroll in M&S Labs services, you authorize Antler Technologies Inc to:

• Keep your payment information securely on file
• Charge your subscription on your scheduled billing date
• Renew your subscription automatically unless you cancel as set out in our refund policy
• Charge for any additional services you choose to receive

5. Authorization for shipping

You acknowledge and agree that:

• Prescribed medications count as dispensed when the pharmacy ships them, not when they are delivered
• Once medications have been handed to the shipping carrier, Antler Technologies Inc is not liable for shipping delays, carrier errors, or lost packages
• It is your responsibility to give an accurate shipping address and, where applicable, to make sure someone is available to receive temperature-sensitive medications

6. Key disclosures

• Some medications prescribed through our platform may be compounded, and these are prepared by state-licensed compounding pharmacies. Compounded medications are not FDA-approved and are not evaluated by the FDA for safety, efficacy, or quality.
• Based on your health profile, your provider will decide which treatment is most appropriate
• Results differ from person to person and are not guaranteed
• Some of the content on our platform may be generated or assisted by artificial intelligence
